By participating in this Promotion, you agree to be bound by these Terms & Conditions.

In addition to these Terms & Conditions, the rules, regulations and methods of participation of the Promotion, which are set out on http://www.zed.com.my shall also apply. Failure to comply with the same will result in your disqualification from the Promotion.

The Promotion shall in all respects be governed by the laws of Malaysia. Kindly be reminded of your responsibility to ensure that your participation complies with all applicable laws.

Promotion & Participants

The "€˜Power Up Pack Contest"€™ ("€œPromotion"€) is open to all pre-paid and post-paid customers of Maxis, DiGi and Celcom who are:

• residents of Malaysia; and
• aged 18 years and above. Participants below the age of 18 years must obtain parental/guardian consent to participate.

Employees of Zed Mobile Malaysia Sdn Bhd ('˜ZED'€™) and their immediate family members may participate in this Promotion but will not be eligible to be selected as winners.

Promotion Period

The Promotion commences on 01.11.2010 @ 12.00am and ends on 1.12.2010 @11.59pm.

Participation

• Subscribe to Power Up Pack by sending ON PUP to 32882.
• Subscription to Power Up Pack (PUP) is compulsory for participation in the Promotion.

Winners & Prizes

The five (5) PUP subscribers with the top five (5) highest downloaded content ("€œShortlisted Contestants"€) will be invited for the second round of the competition consisting of a question and answer session. The Shortlisted Contestants will be contacted by Zed via their mobile phone for this question and answer session. Participants are encouraged to keep their mobile phones activated during this period. In the event Zed is unable to contact a Shortlisted Contestant or winner after attempting to do so for three (3) consecutive days, that Shortlisted Contestant/winner will automatically be disqualified and the participant with the next highest score will be selected instead.

Prize1 :

• The Shortlisted Contestant who correctly answers the most number of questions will be eligible to win a Sony Ericsson Hazel mobile phone worth RM750.
• Provided that this Shortlisted Contestant must maintain his/her subscription during the promotion period.

Prize2:

• The Shortlisted Contestant who correctly answers the second highest number of questions will be eligible to win a Sony Ericsson W595 mobile phone worth RM550
• Provided that this Shortlisted Contestant must maintain his/her subscription during the promotion period.

In the event there are two (2) or more participants with the same download, at the end of the Promotion Period, the participant who obtained that highest download first during the Promotion Period (based on the date/time - date:hour:minute) shall be deemed the Shortlisted Contestant In the event there are two (2) or more Shortlisted Contestants with the same number of correct questions, The Shortlisted Contestant who answered the questions in the fastest time is considered to have the higher score.

The determination of the winners is at the full and absolute discretion of Zed. Results once announced are final. Disputes, appeals or correspondence will not be entertained.

All prizes are used/taken entirely at the risk of the winner at all times and Zed excludes all warranties and liability in connection with any prize to the fullest extent permitted by law. Prizes are non-transferable and non-exchangeable for cash.

Each participant is entitled to win 1 prize only.

If a specified prize becomes unavailable due to unforeseen circumstances, Zed may at its discretion substitute a similar prize or one of equivalent value.

Prizes may only be collected upon verification of the winner'€™s Identity Card (NRIC) number and their mobile phone number. If requested by the winner, the prize can be delivered to them at their designated address, at their risk.

Prizes must be collected within 14 days from the date of notification. In the event a winner fails to collect his/her prize within this stipulated time, the winner is deemed to have waived any and all claims to that prize, and such prize may be dealt with according to the absolute discretion of Zed and any applicable regulations.

Winners shall be responsible for additional costs, duties, taxes and/or other incidental expenses (if any) which may be incurred as a result of and/or related to the winners'€™ acceptance of the prize.

Acceptance of the prize constitutes permission to Zed to use the winner'€™s name, photograph and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law.

Acceptance of the prize constitutes a release and discharge of Zed and its affiliates and partners (including their agents, employees, officers and representatives) , by each winner from any and all liability, claims, demands, actions and/or damages which the winner may have, whether known or unknown at the present time, of any nature whatsoever, arising out of or relating to :

• the Promotion
• personal injury and/or property damage, theft or loss suffered by the winner as a result of the use and/or employment of the prize (to the fullest extent allowed by law)
• any tax liabilities in relation to the Promotion, prize and/or use or enjoyment of the same.

Miscellaneous

There may be circumstances due to volume and network capacity management or other factors beyond the control of Zed whereby notification of certain game play mechanics may occur outside the Promotion Period. Such game play mechanics will be disqualified.

You will not be entitled to any refund for any disqualified game play mechanics, or for any game play mechanics notified outside the Promotion Period due to volume and network capacity management or other circumstances beyond the control of Zed.

By participating in the Promotion, the participant expressly consents to his/her particulars being posted on http://www.zed.com.my or any other medium (whether on-line, print or through any media) as Zed sees fit for purposes of announcing the winners.

Liabilities

Zed and their agencies, affiliates, and representatives are not responsible for any defects or deficiencies in the prizes or misuse of any prize, or for any claims, liability, loss or damage arising out of or in connection with the Promotion.

Zed shall not have any liability or responsibility for any loss or damage of whatsoever nature arising from any participation, or non-participation or any delays in participating or failure to participate in the Promotion.

Rights

Zed reserves the right:

• to change, amend, revise, supplement, delete, vary or add to these Terms & Conditions without prior notice at any time and you shall be bound to such changes, amendments, revisions, supplements, deletions, variations or additions.
• at its sole discretion to cancel, suspend, modify or delay the Promotion or tabulation of votes in the event of unforeseen circumstances beyond its reasonable control.

By your continued participation in this Promotion, you will be deemed to have accepted any changes, amendments, revisions, supplements, deletions, variations or additions which may be published in http://www.zed.com.my.
